Section 439 of the Income-tax Act, 2025 provides for penalty where income is under-reported or misreported. It replaces Section 270A of the 1961 Act, with the same rates: 50% of the tax on under-reported income, and 200% where the under-reporting is a consequence of misreporting. Section 440 provides for waiver of penalty and immunity from prosecution on conditions.
