Section 161 allows an authority to rectify any error apparent on the face of the record in an order passed by it. It can be initiated by the officer or on an application by the taxpayer.
GST, Chhattisgarh
Overview
Rectification is suitable for clear errors such as wrong figures, double counting, or demands based on obvious data-entry mistakes, without the cost and pre-deposit of an appeal.
When this applies
- Arithmetical or clerical errors in the order
- Demand based on wrong return figures
- Payments made not considered
Time limit
Point out the error within three months from the date of issue of the order. The officer cannot rectify after six months from the date of issue, except where the correction is purely clerical or arithmetical. Rectification adverse to the taxpayer needs a hearing.
